A driver is generally engaged in interstate commerce when the commercial movement crosses state lines or forms part of a shipment moving between states or countries.
A driver does not always need to leave New York for the operation to be considered interstate. For example, a driver may collect freight at a New York port, rail terminal, or distribution center and deliver it to another location within the state. If the shipment originated outside New York and is continuing as part of the same interstate movement, federal interstate requirements may apply.
Intrastate commerce
An operation is generally intrastate when the driver and shipment move entirely within New York and the cargo is not part of a wider interstate or international movement.
New York applies the HOS provisions adopted from 49 CFR Part 395 to covered intrastate operations, subject to the state’s listed exceptions. Classification still matters because it can affect exemptions, licensing, record keeping and enforcement.
Principal HOS Limits for Property-Carrying Drivers
For most covered property-carrying drivers operating in New York, the primary HOS limits are based on the federal framework.
11-hour driving limit
A driver may drive for up to 11 hours after completing at least 10 consecutive hours off duty. The limit applies specifically to driving time. It does not mean that every activity performed during the shift can be excluded from the driver’s overall duty window.
14-hour driving window
A driver may not drive beyond the 14th consecutive hour after coming on duty following at least 10 consecutive hours off duty.
The 14-hour clock continues to run even when the driver is not driving. Time spent waiting at a warehouse, completing an inspection, loading cargo, fueling the vehicle, or performing administrative work can consume the available window.
This is particularly important in New York, where relatively short routes can involve substantial non-driving time.
30-minute driving break
A driver must take a break of at least 30 consecutive minutes after eight cumulative hours of driving without a qualifying interruption.
The requirement can generally be satisfied by a consecutive 30-minute period recorded as:
- Off duty
- Sleeper berth
- On duty but not driving
- A qualifying combination of non-driving statuses
Breaks should be placed at practical and appropriate locations. Simply adding 30 minutes to a route does not ensure the driver will have somewhere safe and legal to stop.
60/70-hour cumulative limit
A driver may not drive after accumulating:
- 60 on-duty hours in seven consecutive days when the carrier does not operate commercial vehicles every day of the week; or
- 70 on-duty hours in eight consecutive days when the carrier operates every day of the week.
A driver can generally restart the seven- or eight-day calculation after taking at least 34 consecutive hours off duty.

Short-Haul Operations
Some drivers may qualify for the federal short-haul exception when they operate within a 150 air-mile radius of their normal work-reporting location and satisfy the applicable return-to-base and duty-period requirements.
Qualifying short-haul drivers may be exempt from maintaining a standard record of duty status. However, short-haul status does not remove the underlying limits on driving or working time. The motor carrier must still maintain accurate time records.
A short-haul operation should not be determined by road mileage alone. An air mile is a nautical mile, and the qualifying radius is measured from the normal work-reporting location rather than by the distance travelled along the selected roads.
Route planning systems should therefore distinguish among:
- Actual road distance
- Air-mile eligibility radius
- Driver duty duration
- Time required to return to the reporting location
A driver can remain within the geographic radius but lose eligibility if congestion, loading delays, or additional stops prevent a timely return.
Industry-Specific Exceptions
New York’s intrastate regulations identify exceptions for certain types of work. Depending on the precise conditions, these can include:
- Some farm vehicles and agricultural transportation
- Tow trucks responding to roadside-service requests or removing disabled, wrecked, abandoned, or illegally parked vehicles

Trucks should generally leave a designated route only when necessary to reach the local origin or destination.

Vehicle height, width, length, weight, axle count and trailer configuration can affect which bridges, tunnels and streets are available.
For example, New York City imposes specific operating restrictions on 53-foot trailers. A route that fails to account for those limits may require a lengthy diversion or an additional permit.
